Requirements for Certificate of Exportation and Expansion of Emergency in Zaruma


Requirements for obtaining the Export Certificate
 
The Executive Director of the Mining Regulation and Control Agency, through Resolution No. 017-ARCOM-2017, published in Official Gazette No. 103 of October 19, 2017, issued mandatory requirements for obtaining the Export Certificate by Mineral Rights Holders.
 
The purpose of this Resolution is to determine the procedure for holders of mining rights - whether legal or natural persons - to request, through the Mining Management System ("EMS"), the export certificate.
 
In order to obtain the aforementioned certificate, the holders of mining rights must load the following documents to the EMS:
 
a) Holders of mining concessions and mining operators
 
  1. Sales invoice.
  2. Production certificate.
  3. Electronic proof of payment of the payment of royalties or withholding of income tax, if applicable, the note of deposit must also be attached.
  4. The Customs Export Document (EAD).
  5. Detailed list with the numbers and weights of the mineral to be exported (Packing list).
 
b) Marketing licenses and authorization holders for installation of benefit plants
 
  1. Bills of purchase of the mineral, detailing the mining right where the mineral was purchased, purchase invoices from BIESS or documents that support the payment in payment and their respective withholding at the source.
  2. Sales invoice.
  3. Electronic proof of payment of the withholding tax on the source of income tax and your note of deposit in the corresponding cases.
  4. Customs Export Document (EAD).
  5. Detailed list with the numbers and weights of the mineral to be exported (Packing list).
  6. Production certificate for benefit plants.
  7. All documents mentioned above must be signed by the person responsible for the export certificate.
 
It is also necessary to take into account the Resolutions issued by the Internal Revenue Service, regarding the payment of royalties and deductions in the source of income tax.
 
All the information sent will be regulated by article 4 of the Law of National System of Public Data Registry, so that mining rights holders submitting the information required to obtain the certificate in question will be responsible for the truthfulness and authenticity of the information delivered.
 
 
 
Expansion of state of exception of the mining area Portovelo - Zaruma
 
The Executive Director of the Mining Regulation and Control Agency, through Resolution No. 018-ARCOM-2017, published in Official Gazette No. 105 dated October 23, 2017, issued measures to enforce the declaration of state of emergency and extends the declaration of state of exception of the Portovelo - Zaruma mining area.
 
The resolution authorizes the contracting of goods, works or services including consulting services, through the emergency procedure, indispensable to solve the needs arising from the collapse of the area in the city of Zaruma, Zaruma, province of El Oro (In accordance with the provisions of the Organic Law of the National System of Public Procurement and the Codification and Updating of Resolutions issued by the National Public Procurement Service).
 
It is also provided that once the emergency situation has been overcome, detailed reports of the contracting will be published, indicating the budget used and the results obtained.
