El Gobierno del Ecuador emite el Mapa para la Planificación de la Gestión Minera del Ecuador.



La Superintendencia de Compañías, Valores y Seguros expidió el Reglamento sobre Disolución, Liquidación, Cancelación y Reactivación de Compañías Nacionales y Revocatoria del Permiso de Operación, cuyo objeto es regular el procedimiento de ejecución de la disolución, liquidación, cancelación y reactivación de compañías nacionales, el trámite abreviado, así como también la revocatoria del permiso de operación, liquidación y cancelación de compañías extranjeras sujetas al control y vigilancia de la misma.

On May 2, 2019, the bill for the reform of the Mining Law was presented, which was qualified by the Legislative Administration Council of the National Assembly on October 2, 2019 and which will be analyzed by the commission of biodiversity and natural resources.


El 2 de mayo de 2019 se presentó el proyecto de ley reformatoria de la Ley de Minería, el cual fue calificado por el Consejo de Administración Legislativa el 2 de octubre de 2019 y que será tratado por la comisión de la biodiversidad y recursos naturales.


Se publicó la Guía Técnica de Procedimientos de la ARCOM de la Agencia de Regulación y Control Minero ARCOM en el Registro Oficial Edición Especial número 29 de 13 de agosto de 2019 con respecto a los procedimiento para (i) la gestión de la administración de información minera y (ii) la gestión de control y vigilancia técnica.

ALERTA MINERA NO. 10 - REFORMAS LABORALES

En los primeros días de agosto de 2019 se han publicado dos importantes reformas normativas en el ámbito laboral con implicancias para la industria minera: (i) las reglas para implementar la acción afirmativa a favor de residentes y pueblos y nacionalidades en la Amazonía y (ii) las normas para autorización de horarios especiales de trabajo.

Mining Alert No. 9- ARCOM Resolutions

On Friday, July 12th, 2019, the Mining Regulatory and Control Agency (hereinafter “ARCOM”) published in the Official Register No. 529, three resolutions. The first one (No.004-001-2019-Dm-ARCOM), issued the partial reform to the Organic Statute of Organizational Management by Processes, the second one (No. ARCOM-ARCOM-2019-0013-RES), issued regulation for transport of mineral resources and the third one (No. ARCOM-ARCOM-2019-0014-RES), issued the instruction for the handling, administration and replacement of petty cash funds.

Alerta Minera No. 9-Resoluciones ARCOM

El viernes 12 de julio de 2019 se publicó en el Registro Oficial No. 529, las resoluciones de la Agencia de Regulación y Control Minero (en adelante “ARCOM”). La primera (No. 004-001-2019-Dm-ARCOM), expidió la reforma parcial al Estatuto Orgánico de Gestión Organizacional por Procesos, la segunda (No. ARCOM-ARCOM-2019-0013-RES), expidió la regulación para el transporte de recursos minerales y la tercera (No. ARCOM-ARCOM-2019-0014-RES), expidió el instructivo para el manejo, administración y reposición del fondo de caja chica.


El 10 de junio del 2019 el Ministerio del Ambiente (“MAE”), mediante acuerdo ministerial No. 055 declaró a la “Cordillera Oriental del Carchi” y la incoporó en el Sistema Nacional de Áreas Protegidas del Ecuador. La nueva área cuenta con una superficie de 20.349,79 hectáreas, ubicada enlos cantones Bolívar, Montufar, Tulcán y San Pedro de Huaca y será administrada y gestionada por el GAD del Carchi.

Para la declaratoria de este tipo de áreas, el Ministerio del Ambiente verifica que el área que se solicita declararse como área protegida (i) complemente los esfuerzos del Sistema Nacional de Áreas Protegidas, (ii) que sea relevante en la protección de patrimonio natural del país; (iii) que aporte al cumplimiento de los objetivos nacionales de conservación; (iv) que no se contraponga con las correspondientes disposiciones del ordenamiento jurídico vigente; y, (v) que determine la viabilidad de declarar un espacio del territorio como área protegida, con base a los siguientes criterios:

  • Conservación:
    • Cuente con espacios naturales que solventen los vacíos de conservación, conectividad y representatividad de la biodiversidad del país;
    • Cuente con ecosistemas frágiles y amenazados como páramos, humedales, manglares, bosques nublados, bosques tropicales secos y húmedos, ecosistemas marinos y marinos costeros, entre otros;
    • Registrar la presencia de poblaciones viables de especies que tengan algún tipo de amenaza o endemismo;
    • Generar servicios ecosistémicos, en especial los que benefician la vida humana como hídricos, paisajísticos, prevención de desastres, mitigación, etc.;
  • Estatus Legal:
    • Un representante legal, quien se constituirá en el interlocutor directo con el MAE;
    • En caso de un predio privado debe contar con los títulos de propiedad o documentos que acrediten la titularidad sobre su predio.
  • Ordenamiento Territorial:
    • Evitar la superposición entre los espacios a ser declarados áreas protegidas acorde al modelo de desarrollo sustentable establecido por el Estado.

En consecuencia, no se podrá ejecutar actividades extractivas de recursos no renovables, incluyendo actividades mineras, en la nueva área protegida, de acuerdo a lo establecido en el artículo 405 de la Constitución de la República y el 45 del Código Orgánico del Ambiente. .


The Ministry of Energy and Non-Renewable Natural Resources published the updated Mining Public Policy dated May 15, 2019, which has 6 themes: economic development; environmental and social sustainability; investigation and development; management and administration; regulation, control and combat against illegal mining; and, law and regulations. Each theme has strategic objectives (the theme of environmental and social sustainability has 2 strategic objectives), and each of them has a public policy. Additionally, each theme has 4 effective interventions (except for the themes of (i) regulation, control and combat against illegal mining and (ii) regulations, which have 2 effective interventions).

The strategic objective of the economic development theme is to "position the mining sector as an important industry of the national economy", with its public policy to "increase and diversify the production of the mining sector, encouraging long-term domestic and foreign private investment, generator of employment [...] ". Of its 4 effective interventions, the most relevant are:

  • Implementation and optimization of fiscal incentive mechanisms to promote mining investments in the country, such as tax refunds, guarantee contracts and tax stability.
  • Establishment of standard contracts between the State and mining companies for negotiation and drafting of a contract that contain a minimum of necessary or appropriate provisions, framed in the principles of legality, equity, balance and care of the environment.
  • Creation of mining clusters through articulation between mining and related industries (mining inputs, metalworking, metal processing and smelting).

The theme of environmental and social sustainability has 2 strategic objectives: (1) adoption of good environmental practices and occupational safety and (2) harmonization of the relationships between mining stakeholders, promoting the development of the areas of influence, with their respective public policies: (a) promotion of the use of natural mineral resources and (b) strengthen the community bond and the social responsibility of those who carry out mining activities. Of its 4 effective interventions, the most relevant are:

  • Strengthening of community relations, particularly the spaces in which the actors (companies and communities) can reach an agreement for the development of sustainable mining projects in accordance with social and environmental development. It includes optimizing the process of prior consultation.
  • Guarantee the right to free, prior and informed consultation and other spaces for dialogue, through its definition, including verification of the presence of peoples, nationalities, communes and communities to whom it applies, as well as other spaces for dialogue and participation.
  • Design and implementation of incentive mechanisms for regional and local governments in mining regions for use royalty resources.

The strategic objective of the research and development theme is to strengthen geological, mining and metallurgical research, with its public policy to "promote research, innovation, technology transfer, and entrepreneurship for the development of the mining sector." Of its 4 effective interventions, the most relevant are:

  • Promotion of mining innovation through competitive funds, direct subsidies or tax incentives that increase innovation of mining companies.
  • Definition of the ideal zones to carry out mining activities based on the following criteria: social, environmental, water (water sources declared of public interest and areas of water importance), productive, economic, technical, safety and risk.
  • Update of the categorization of mining activities based on a review of technical aspects (exploitation designs, production volumes, associated infrastructures, tax requirements) for all mining regimes.

The theme of management and administration has as a strategic objective to articulate the functions and competencies of the public institutions involved in the mining sector, with its public policy to promote an articulated, timely and efficient public administration. Of its 4 effective interventions, the most relevant are:

  • Simplification of procedures and reduction of delays for a natural or legal person to obtain mining titles for exploration, exploitation or benefit and its operation.
  • Reorganization of the mining cadastre through a verification of the mining areas that have been graphed, based on mining titles in force or in process of being obtained and the implementation of operational assurances for a transparent management of information.

The theme of regulation, control and fight against illegal mining has as a strategic objective to strengthen the structure of administration, regulation and control of the State, through the application of audit processes, and monitoring of mining activities, with its public policy to improve the capacity of administration, regulation and control of the State over mining activities, including control of illegal mining. Of its 2 effective interventions, the most relevant are:

  • Control of illegal mining.
  • Control of the traceability of the ore that is processed.

The law and regulations theme has as its strategic objective to promote a solid regulatory framework for the development of the mining industry, through the review, analysis and proposals of a mining regulation to promote rule of law in the sector, with its public policy to improve the mining industry’s regulatory framework to enable its development. Of its 2 effective interventions, the most relevant are:

  • Training of judicial officials in coordination with the council of the judiciary.
  • Review and proposal of adjustments to the regulatory framework.
